Amaryllis Nucleics Product Terms of Sale
The following are the terms and conditions by which Amaryllis Nucleics Inc. (“AN”) sell our product to you. These terms govern purchases made by you from AN. By purchasing from AN you are accepting the following terms.
Products are for research use only and not intended for use for human therapeutic or diagnostic purposes.
Orders are subject to availability and our acceptance. We reserve the right to make deliveries in installments which will be invoiced separately. We may make changes to the products that do not materially affect the performance or quality of the products.
Products are considered delivered when possession is taken of the parcel by the commercial carrier. Title of the products is passed to the customer upon transfer to the carrier. At this point risk of loss or damage is assumed by the purchaser. If loss or damage occurs in transportation, we will work with the customer and the carrier to attempt to resolve the issue.
The customer may return products which are damaged or defective upon delivery for refund or replacement by contacting customer service within 14 days of receipt. Products must be returned within 21 days of receipt. Customer service must be contacted within 14 days of receipt or the products will be deemed as accepted.
For products returned properly, at our discretion, we may refund the cost of the product and shipping charges or replacement of the product free of charge.
Our prices do not include any taxes (including VAT), duties, levies or other government fees that may apply to your order. If they apply, it will be your responsibility to pay them. If we pay them they will be added to your invoice. You are also responsible for shipping charges which when applicable will be added to your invoice.
To the maximum extent permitted by applicable law, we will not be liable under any legal theory (including but not limited to contract, negligence, strict liability in tort or warranty of any kind) for any indirect, special, incidental, punitive, multiple, exemplary or consequential damages (including but not limited to costs of cover, lost profits, lost data, loss of business, loss of goodwill or loss of revenue) that you might incur under the contract, or that may arise from or in connection with our products or services, even if we had notice of the possibility of such damages. In addition, our maximum aggregate liability arising out of or in connection with the contract, or any product, is limited to the amount you paid to us for the product purchased.
Delivery dates and times are estimates only and we will not be liable (in contract, tort or otherwise) for any losses, expenses, claims or damages caused by a late delivery.
All disputes as to the legality, interpretation, application, or performance of this order or any of its terms and conditions shall be governed by the laws of the State of California including its conflict of laws principles.
